Terms of Service

These Terms of Service ("Terms") govern access to and use of CoachingWallah (the "Service"), a CRM platform for coaching institutes. By creating an account or using the Service, you ("Institute", "you") agree to these Terms.

1. The Service

CoachingWallah provides tools to manage leads, students, courses, fees, attendance, communication (WhatsApp/SMS/email), and related administrative functions for coaching institutes. Certain features (e.g. AI-assisted lead scoring, drop-risk analysis, reply suggestions) are optional and billed separately via a credit system.

2. Accounts & Trial

  • You must provide accurate information when creating an account and keep your login credentials confidential.
  • New accounts include a 14-day free trial. No credit card is required to start the trial.
  • You are responsible for all activity carried out under your account, including by team members you invite.

3. Subscription & Billing

  • Continued access after the trial period requires an active paid subscription, billed monthly in advance via Razorpay.
  • Subscription fees are non-refundable except as described in our Refund Policy.
  • If a subscription lapses, access to the Service is suspended until renewed. Your data is retained and not deleted solely due to a lapsed subscription.
  • AI features are billed separately through a prepaid credit system; credits are consumed only when an AI feature is used.

4. Your Data

You retain ownership of all data you submit to the Service (leads, students, communications, and related records). We process this data to provide the Service on your behalf, as described in our Privacy Policy. You are responsible for having a lawful basis to collect and store personal data of your leads, students, and their guardians within the Service.

5. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk messages (spam) via WhatsApp, SMS, or email in violation of applicable law or the messaging provider's policies (e.g. Meta's WhatsApp Business policies).
  • Upload unlawful, infringing, or fraudulent content.
  • Attempt to gain unauthorized access to another institute's data or to the Service's infrastructure.
  • Reverse-engineer or resell the Service without our written consent.

6. Third-Party Services

The Service integrates with third-party providers you choose to connect — including Razorpay (payments), Meta WhatsApp Cloud API and Twilio (messaging), OpenAI (AI features), and Google Calendar. Your use of these integrations is also subject to those providers' own terms.

7. Termination

You may stop using the Service and cancel your subscription at any time from Settings. We may suspend or terminate accounts that violate these Terms or applicable law, with notice where reasonably possible.

8. Disclaimer & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, CoachingWallah is not liable for indirect, incidental, or consequential damages arising from use of the Service, including loss of leads, revenue, or data.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or an in-app notice before taking effect.

10. Governing Law

These Terms are governed by the laws of India, and courts in India shall have exclusive jurisdiction over any disputes arising from them.
